Senator Hill will have a news conference at 10 a.m. Monday, Feb. 25, at the state PUC building at 505 Van Ness Avenue in San Francisco. We are all invited to come and support our Senator. Mayor Jim Ruane is planning to do so. The news conference will mostly address separation of functions, which is the response to CPUC President Peevey using the PUC’s General Counsel to cancel the San Bruno penalty hearings last October.
Specifically, the bill:
1) Would explicitly call for separation of PUC staff for prosecutorial and the adjudicative functions in an adjudicative proceeding. This is part of the Administrative Procedures Act, clearly stated in FERC regulations, and already general practice that the PUC. This provision is in response to a situation during the San Bruno penalty proceedings where the PUC president, through the General Counsel, was directing staff counsel to find ways to settle, even though staff counsel was not looking to take that course.
